“合理性”:司法鉴定意见实体审查标准

“Rationality”:The Substantial Standards of Judicial Authentication Opinions

真正能让法官对司法鉴定意见产生内心确信的标准是其"合理性",即合乎事实、合乎理性、合乎规律与合乎逻辑。因此,"合理性"才是司法鉴定意见的实体审查标准,是司法鉴定意见最具价值的因素。以"合理性"为标准,有利于法官对鉴定意见进行准确认证、提高鉴定文书的质量、提升司法公信力。违背现有鉴定规范和技术标准的鉴定意见、明显违背经验法则的鉴定意见以及没有依据支撑的鉴定意见,都不符合"合理性"标准。应该完善司法鉴定标准立法,加强司法鉴定人才队伍建设,提升司法鉴定能力,规范鉴定意见审查认证过程中的法官自由裁量权,以此完善司法鉴定实体审查的制度建构。

The inner standard for judicial authentication opinions that really convinced judges is the＂rationality＂,namely to be in line with facts,rational,and logical.As a result,the rationality is the substantial examination standards of judicial authentication opinions,the most valuable factor in judicial authentication opinions.The standard of＂rationality＂is helpful for judges to evaluate authentication opinions accurately,to improve the quality of identification documents,and to promote the judicial credibility.The judicial authentication opinions which are against the existing appraisal regulations and technical standards,those which obviously violate the rule of thumb,and those which are not in accordance with the appraisal opinions,do not conform to the standard of＂rationality＂.Legislation should perfect the judicial authentication standard,strengthen the talent team of judicial authentication,improve the capacity of judicial authentication and regulate the judge discretion in the process of review and certification of expert opinion,so as to perfect the system of judicial identification of physical examination.
