作者中心主义及其合法性危机——基于作者权体系的哲学考察

Author-centrism and its crisis of legitimacy:A philosophical study based on the author's rights

作者中心主义是作者权体系的灵魂核心,其产生于法国大革命时期。它将作者置于著作权权利结构的中心,并赋予作者神圣的精神权利。作者中心主义的哲学基础是浪漫主义、康德与黑格尔的人格权理论、近代主体性哲学和传统解释学,这些哲学为作者的文学财产权提供了合法性基础,这也是作者中心主义得以源远流长的内在原因。但结构主义、语言哲学、哲学诠释学的兴起与主体范式的破产直接动摇作者中心主义的哲学基础,使作者权扩张的合法性遭受质疑。

Author-centrism is the soul of the system of the author＇s rights,which originated in the period of the French revolution.It brings the author to the center of copyright,and gives the author the holy moral rights.The philosophical foundation of author-centrism is Romanticism,while Kant and Hegel＇s theory of publicity rights,modern subjective philosophy and traditional hermeneutics pro-vide the basis of legitimacy for the author＇s rights to literary property,which is also the internal rea-son for the endurance of author-centrism.However,the emergence of structuralism,the philosophy of language and philosophical hermeneutics as well as the collapse of the dominant paradigm shake the philosophical foundation of author-centrism directly,so that the legitimacy of the expansion of the au-thor＇s rights suffers from criticism.
