Partnerships between Administrative Law and Public Administration in the Context of Governance

行政法与公共行政是一种既对立又统一的关系。行政法以正义为首要价值追求,要求的是公正性、稳定性和可预期性;而公共行政以效率为首要价值目标,要求的是适应性和灵活性。在传统的"命令-服从"行政管理模式下,行政法成为了行政的附庸,公共管理的目标往往掩盖了行政法的价值,行政法与公共行政的相互游离、相互背反的对立面被扩大了。治理现代化的兴起为二者关系的转变提供了社会动因。治理意味着政府将更多地通过与私方合作的方式完成公共任务,行政法必须从结构、方法、思维诸多方面进行回应,从而建立二者的合作伙伴关系。

Administrative law and public administration have the relation of unity of opposites.Administrative law primarily pursues value of justice, which requires justice, stability and predictability.While public administration primarily targets for value of efficiency,which requires adaptability and flexibility.In the traditional Command-Obedience administrative mode,administrative law became a vassal of administration.The goal of public administration tended to obscure the value of administrative law.The opposite of administrative law and public administration,which was dissociated and violated with each other,was expanded.The rise of modern governance provides a social motivation for the change of the relationship between them.Governance means that the government will complete common tasks more through cooperation with private parties.administrative law must structures,methods,and many other aspects of thinking to respond in order to establish a partnership between the two.
