论刑法的反向歧视

On Reverse Discrimination in Criminal Law

在道德论和对女性性义务苛求的观念之下,我国的刑法立法在强奸罪和强制猥亵妇女罪的条文背后潜藏着反向歧视。反向歧视意味着对女性私人领域的过度干预,并容易造成"二次伤害"。但是,反向歧视却被掩盖在刑法基本原则之下。只有归位对女性的社会道德评价并充分尊重女性的自身价值,才能从根本上克除刑法的反向歧视,以实现刑法构建的性别平等。

Due to the influence of sexual obligation concept of moralism,reverse discrimination exists behind the clauses of crime of rape and crime of compulsory indecency in the legislation of our country.Reverse discrimination means excessive intervention to a female＇s private sector,which brings about the secondary damage to a female easily.However,reverse discrimination is covered under the fundamental principles of criminal law.If we want to eradicate the reverse discrimination in criminal law to realize the gender equality constructed in criminal law,we should put the social moral evaluation of female in the right place and fully respect the self-worth of female.
