摘要
实行教师聘任制对高校落实依法治校、扩大办学自主权有着重大的现实意义。因对聘任合同法律性质缺乏统一的规定,各高校解决合同履行过程中所产生纠纷的方式差异较大。本文在厘清高校教师聘任合同主体的法律地位、明确高校教师聘任合同是私法主导性质的劳动合同的基础上,阐明以劳动争议解决机制保障合同双方合法权益的路径。
The employment system in public institution of higher education is important for managing university's affairs according to the law. The legal attribute of employment contract for teachers of public institution of higher education has been controversial. It is necessary to define the private legal attribute of the employment contract through defining legal status of employment contract parties. It is practicable to solve the disputes between the university and teachers through the system of labor dispute settlement.
