论中国社会救助管理法治化

The Managerial Legislation of Social Assistance in China

中共十八届四中全会提出"努力实现国家各项工作法治化"。推进社会救助立法和法律完善,从而实现社会救助管理的法治化,是中国社会救助发展面临的现实课题。文章立足于中国社会救助制度发展的阶段性特征和趋势,提出了社会救助管理法治化的理论范畴,并以此为研究视角,分析了社会救助管理法治化面临的现实环境、发展原则和发展目标。当前,中国经济发展的不平衡性是社会救助管理法治化面临的现实国情;同时,中国社会救助事业要以社会救助的管理法治化为引领和依托,着力构建政府、社会组织和个人共同参与的社会救助工作新格局以及事权责任明晰的社会救助管理体制。此外,在社会救助管理法治化和制度转型的过程中,需要着力建设社会救助和谐文化,促进社会救助的结构优化,努力打造中国社会救助制度的升级版。

To promote the legislation of social assistance and improve legal system is of great importance for the development of social assistance in China. Based on the stage characteristics of economic development and the developmental trend of Chinese social assistance, this paper puts forward the theoretical concept of managerial legislation of social assistance, argues that the imblance of economic development across China is the basic national conditions for the managerial legislation of social assistance. Meanwhile, the Chinese social assistance must be guided by the law and governed by the law, and it is necessary to build the new institu- tional framework of social assistance in which the governments, social organizations and the individuals can work together to realize the cooperative governance. In addition, it is also needed to focus on building the har- monious culture of social assistance and promote the structural optimization of social assistance recipients to build the updated version of social assistance system in the development of social assistance managerial legal- ization and institutional transformation in China.
