摘要
海事强制令是海事诉讼特别程序法所特有的法律制度,随着十几年的司法实践,它在理论和实践上的困惑和不完善也随之显现。文章结合海事司法实践,并分析海事强制令现行规定存在的不足,提出完善建议,包括明确独立属性、细化适用条件、完善复议制度和建立听证制度等。
Maritime injunction is unique to the special maritime procedure. With more than 10 years of legal practice, its confusion and incompleteness in theory and in practice also appears. Combining maritime judicial practices, this paper analyzes the shortcomings of existing provisions of the maritime injunction, and puts forward a proposal, including specifying independent properties and application conditions, improving the review system and establishing the hearing system.
