摘要
腐败虽是由人性弱点和社会环境及政治权力等多种因素引发的,但腐败不是不可控的,相反是可以治理的。在世界历史上,甚至在现代世界许多国家中,乃至在国际社会范围内,通过立法形式治理腐败,已成为一种有效的对策和办法。文章从法理视角着眼,以《彭德尔顿法》和《职业道德法》为研究对象,梳理和考察近两个世纪以来美国联邦政府腐败治理的过程,从中总结出其成功经验,以利于为当下的中国政府改革和反腐廉政建设提供理论借鉴。
Corruption usually results from various factors, such as the weakness of human nature, the social environment, as well as political power. But corruption might be controlled and governed. The corrup- tion governance by legislature has become an effective policy and way in many modern countries, even in the international society. From the perspective of legal principle, this paper focuses on "The Pendleton Act " and " The Ethics in Government Act", and examines the process of America federal government's two-cen- tury corruption governance. In addition, it sums up the successful experiences of the United States that would be helpful to the government reform and the construction of anti-corruption and clean-government in current China.
