港台地区政策性措施推动本地ADR发展对内地与澳门的启示

Enlightenment of Hong Kong Region and Taiwan Region's Policy Measures to Promote Development of Local ADR on Mainland and Macao

近些年来港台地区ADR(多元争端解决机制)取得了令人瞩目的快速发展,其成就与台湾当局、香港特区政府的大力支持密不可分,这主要体现在仲裁法律规范的不断完善以及一系列驱动本地ADR发展的具体行政措施之中。较于港台地区先进、国际化的ADR制度,内地与澳门无论是实施理念还是规范体系上都还存有较大差距,港台地区对于推进仲裁发展的一些支持性举措值得内地与澳门学习借鉴。通过比较研究的方法探寻当前两岸四地关于推进本地ADR发展的政策上的差异性,从区别当中提出完善内地与澳门ADR制度的些许建议,为两岸四地ADR事业的共同进步与发展尽绵薄之力。

In recent years,Hong Kong Region and Taiwan Region＇s ADR（ alternative dispute resolution mechanism） has made rapid development and attracted world ＇s attention,and these achievements are mainly comes from the government＇s of Taiwan Region and Hong Kong Specical Administrative Region＇s support,which is mainly reflected in the continuous improvement of arbitration legal norms and a series of specific administrative measures in driving the local ADR to develop constantly.Compared with the Hong Kong or Taiwan Region＇s advanced and internationalized ADR system,there is big disparity between the mainland and Macao both in the ideas of implementation and normative system. For some supporting measures for promoting the development of ADR,Hong Kong and Taiwan Region＇s measures are worth to be learned for the mainland and Macao. This paper explored the fourdistricts of cross-strait government＇s different support policy on promoting the development of local ADR through the method of comparative research,and then put forward some suggestions to improve the mainland and Macao＇s ADR system from comparing those distinctions,which might make some contributions to the common progress and development of four districts of cross-strait＇s ADR careers.
