确权颁证产权创新视角下农村集体土地违规问题研究——以平顶山市为例

Study on Violation of Regulations in Dealing With Rural Collective Land Under Perspective of Confirmation and Certification of Land Property Rights——With Pingdingshan City as An Example

农地颁证确权是土地产权改革的开端和基础。平顶山市农地颁证确权实践证明,若其缺乏创新将会导致农地违规案件的蔓延,引起"确权悖论"。任何忽视农户地权诉求的农地确权模式,不仅违背十八届三中全会产权创新的宗旨,而且恶化农地配置效率与社会公正,最终使以农地确权促进现代农业发展的改革受挫。因此,以解放思想、实事求是原则对现行涉农土地制度进行革故鼎新,既是规避政府主导型确权模式,培育农户主导型确权模式的基本思想,又是规避农地违规使用、优化农地配置、明确政府职责、发展现代农业的长效对策。

The innovation of land property rights is the first step and base in the confirmation and certification of land property rights.The statistics of Pingdingshan showed that it was difficult to overcome violation of regulations in dealing with rural collective land unless innovation is implemented in the confirmation and certification of land property rights.Any form of confirmation and certification of land property rights that ignores farmers＇ desire and innovation will be inevitably contrary to the new purpose of property rights innovation set forward by the Third Plenary Session of Eighteenth National Congress of CPC and make worse the deficiency of land allocation and social justice,thus resulting in a setback of the reform of land property rights confirmation which is originally designed to promote the development of modern agriculture.So it is proposed that we should avoid the governmentdominated mode but foster the farmers-oriented mode of land property rights confirmation and certification,which proves a basic measure to get rid of violation of regulations in land use,better land allocation,make clear the government＇s responsibility,and promote the development of modern agriculture.
