民事自由裁量权滥用的防止与规制方法研究

Study on the Methods to Prevent and Govern the Abuse of Civil Discretion

民事自由裁量权是民事审判权的核心部分,民事法官正确行使自由裁量权是保障民事案件的审判公正与效率的关键。在中国当前的民事审判中,自由裁量权被滥用的情况非常普遍。笔者将对我国民事自由裁量权滥用的情形予以分析,并对如何防止与规制民事自由裁量权的滥用提出自己的建议。

Civil discretion is the core part of civil jurisdiction. The right exercise of discretion of Civil judge is the key factor to guarantee the judicial justice and efficiency of civil case. In current Chinese civil justice ,the abuse of civil discretion are very common. The author analyses the situation of the abuse of civil discretion in China, and then puts forward to his suggestions to prevent and govern the abuse of civil discretion.
