从用户利益角度审视浏览器过滤广告行为的性质——兼评我国首例浏览器过滤视频广告案

摘要 近日,引发热议的优酷诉金山“猎豹”不正当竞争案二审判决已经作出。浏览器自带的广告过滤功能对视频网站的商业模式造成了一定冲击。浏览器开发商的行为是否构成不正当竞争,学界有不同观点,但大多侧重于行为“正当性”分析。而美、德两国却特别重视“用户利益”和消费者选择权的核心地位和决定性影响。本文建议我国司法界更多地关注用户利益和技术中立等公共利益,建议视频网站参考域外经验,适时改进商业模式,提高用户观看体验。 The result of second trial of the case Youku v. Jinsban involved with unfair competition behavior came out several months ago. The universal use of certain browsers with ads-filter would influence the business model and interests of video sites. The lawyers hold different positions on that whether the behavior of the browsers with ads-filter should be considered as unfair competition and most people focus on the analysis of justness. In fact, "User Benefit" and Consumer Choice are playing important roles in the judgment of unfair competition behavior in the judicial practices of the U.S. and Germany, We should pay more attention to the public interests, including the user benefit and technology development, and also improve the business model timely to improve the user experience.
