医疗环境下贫穷与生命权的博弈——“弃疗”的法社会学分析及对策

The Game of Poverty and the Right of Life in the Medical Environment:A Legal-Sociological Analysis of "Abandoning Treatment" and Countermeasures

"弃疗"一词是时下广为流传的一句网络语,颇有嘲讽和娱乐之意。但将之运用到医疗领域内,"弃疗"却不得不令人深思和叹惋。"弃疗"放弃的不仅仅是患者本人的生命,也体现出整个社会对个体生命权的漠视,反映了人之生命与其经济能力直接相关的尴尬境况,以及人与人之间生命权的不平等现象。从生命权的角度对"弃疗"现象进行分析,进而揭示出"弃疗"现象的根源——我国医疗保障法律制度设计之缺憾,不足以保障人之生命权,并且对这些问题提出了相关建议。

As a kind of network language, ＂Abandoning Treatment＂ becomes more and more popular in our daily life, which actually participates of the nature of satire and amusement. But it will provide much material for thought if it is applied to the medical field. The substantive significance of ＂Abandoning Treatment＂ not only gives up the lives of patients, but also reflects the social indifference for personal right of life, showing the tragic situation that human life is directly related to their economic capability, revealing the inequality of the right to life between man and man. This paper firstly analyses the related reasons of abandoning treatment, thus explores the defects in design of Chinese medical security legal system that is not enough to guarantee the right of life, and then puts forward corresponding proposals.
