我国宪法学研究方法述评

A Review of Research Methods in Constitutional Science in China

宪法学研究方法作为宪法学研究的基础,在宪法学理论体系中占有重要的地位。虽然改革开放以后我国宪法学研究方法在学界的重视和推动下得到了不断地发展,但是其中仍然存在着诸多的问题。从宪法学研究方法的概念辨析出发,经由对我国宪法学研究方法历史演变的察看,最后结合我国宪法学研究方法研究的现状来思量其未来的路径是正视我国所处的历史阶段、关切中国现实、客观对待宪法文本和理性对待西方宪法实践。

Research methods,as foundation in the study of constitutional science,stands in an important position in the theoretical system of the constitutional science. Many problems remain unsolved,although research methods have made great progress with efforts of scholars since China's reform and opening-up. Starting from clarifying the concept of research methods in constitutional science,examining the historical evolution of the methods,and taking into consideration of the research of the research methods in China,this paper suggests that the future approach should be correctly understanding China's current historical period,being concerned with China's reality,being objective with constitutional texts,and rationally looking at Western countries' constitutional practice.
