摘要
"商标共存"是司法实践发展而来的原则,它解决的是两个相同或近似的商标均获得商誉后能否同时存在于各自市场的问题。本文在考虑商标的混淆性理论和探讨商标符号使用、商标性使用后,认为"商标共存"是个伪概念,没有独立的价值,而"符号共存"才是其更恰当的称谓。
" trademark coexistence" is a principle evolved from judicial practice, it is to solve coexistence issues of respective markets after two identical or similar trademarks have received goodwill. In this paper, after considering the confusion theory of trademarks and exploring the use of the trademark symbol and trademark itself , I believe "trademark coexistence" is a false concept with no independent value , while "symbolic coexistence" is a more aPProPriate title.
