论法学研究中的问题意识——以法律论证理论的分析为例证

On the Awareness of Problems in Law Research with an Analysis of Legal Argumentation for Example

法律来源于现实生活,它服务于实际问题的解决方能彰显其应用性品格。反思自身的研究创作历程,认识到具有问题意识,在此指引下通过实证分析方法获取经验材料,并发挥实践理性能力从经验材料中总结归纳出理论,然后尝试运用此理论去解决现实问题,才能写出真文章。问题意识确立后,进而采用一定的路径方法实现问题目标的解答。通过对法律论证理论的考察,能在某种程度上印证实际问题意识对法学研究的建构性意义,而且可审视达致当事人接受裁决结论的法律方法应用效能。

Law comes from real life,and it can only highlight its applied character in the services to solve practical issues.We should reflect on its own research creative process and find to have awareness of the practical problems,only under the guidance of which can we write useful articles by grasping ex-perience material through empirical analysis,summarizing theories from accumulated practical reason, and trying to use legal methods to solve realistic problems.After establishing the awareness of problem, we should apply a certain path to achieve the problem goal of answers.Through the investigation of the theory of legal argumentation,to some extent it can not only confirm that awareness of practical prob-lems guides legal creation construction,but also examine legal methods application performance which can help to achieve the parties to accept the ruling conclusions.
