我国医疗损害鉴定机制“一元”模式构建探析

医疗损害鉴定结论在处理医疗损害纠纷案件中起决定性作用,成为处理医疗案件的重要环节。在大量文献检索医疗鉴定关键词的基础上,通过对司法实践现状的分析,发现我国目前"二元化"医疗损害鉴定模式在实践中存在冲突和弊端,对医疗事故技术鉴定和医疗过错司法鉴定机制进行选择性的整合,构建医疗损害鉴定"一元"模式是未来发展的局势,需要统一鉴定机构和鉴定程序、整合鉴定主体、规范质证环节、完善法律法规。

Medical damage appraisal plays a decisive role in settling disputes on medical tort .Therefore ,medical damage appraisal becomes an important approach in handling medical disputes .On the basis of detailed and profound literature review of medical appraisal , the authors analyzed current situation of judicial practice in China and summarized the disadvantages of the dual medical damage appraisal mode in practice .Furthermore ,they argued that the development trend should be selective integration of technical appraisal of medical malpractice and judicial authentication mechanism of medical negligence .A unified medical damage appraisal mechanism should be constructed ,including unification of authentication institutions and identification procedures ,clarification of appraisal subjects ,standardization of cross‐examination procedure and improvement of legislation and regulation .
