《跨境游客保护合作公约草案》述评

Comment on the Draft Convention on Co-operation in Respect of the Protection of Tourists and Visitors Abroad

本文根据海牙国际私法会议的最新资料评述了《跨境游客保护合作公约草案》,指出了该公约草案的特点和不足之处。该公约草案强调利用接受国已有的司法协助和法律援助等救济方式来帮助跨境游客。公约草案对于提升跨境游客私权利的救济具有显著的积极意义,同时有助于中国司法协助水平的提升。该公约草案填补了该领域国际条约的空白,中国应当在深入研究该公约后支持该公约草案成为具有约束力的公约,以便进一步提升我国保护跨境游客的水平。

This article makes a general comment on the Draft Convention on Co - operation in Respect of the Protec-tion of Tourists and Visitors Abroad on the basis of the latest information of Hague Conference on Private Interna-tional Law,and points out the characteristics and inadequacies of this Draft Convention after in depth analysis. The Draft Convention emphasized to use the already established relief system in the receiving country,and to use the ju-dicial assistance and legal aid available to facilitate the international tourists to get relief. This article argues that the Draft Convention will play a significant role in enhancing the relief of the international tourists. The framework Draft Convention filled the blank in the field of international treaty. China should be in favor of making the Draft Conven-tion have binding force in order to further enhance the level of protection of international tourists in China.
