经济法视域下政府购买服务研究

Research on the Purchase of Service Contracting under the Horizon of Economic Law

政府购买服务在理论上属于经济法范畴,应纳入经济法调整。界定政府购买服务的经济法属性、辨识经济合同、预设经济法律关系以及检视国内外实践中经济法的规制范式,有助于理清政府购买服务在经济法调整下的完善进路,促进其良性发展。

Purchase of Service Contracting（POSC）belongs to the category of economic law in theory,so it should be incorporated into the field of economic law.The article is to define the nature of the POSC,to identify the economic contract,to analyze the economic legal relationship,and to review the regulation paradigm of economic law in POSC practiced at home and abroad.At last,it puts forward some suggestions to improve sound development under the horizon of economic law and hope it can be helpful for POSC in China.
