Comprehensively Promoting the Protection of Human Rights under the Horizon of Rule of Law

人权保障不等于人权,它来源于人权理论。它们的重心已悄然地发生着变化,即由以人作为人权的主体转换成了以国家作为人权保障的主要实施主体。视域是一种与主体有关的能力,是"精神的观"。而我国的人权发展进程也历史地注定了我国人权保障视域的独特性。当下,它的时代含义是:国家以保障人权为目标,更好地发挥法治的引领和规范作用。

Guarantee of human rights doesn＇t mean human rights itself.It originates from the theory of human rights,but its subject is quietly changed.That is,people as the subject of human rights transformed into country as the main subject of implementation of safeguarding the human rights.Horizon is a kind of ability related to the subject and a kind of observing by spirit.Meanwhile the historical development of human rights in China determines the uniqueness of our horizon on safeguarding the human rights,and its contemporary sense,by,is that the state shall aim at pursuing the guarantee of human rights and better play its role of the rule of law in guiding and normalizing.
