在泰国,生母是孩子的合法母亲而泰国妇女所生的孩子具有泰国国籍。故,泰国代孕母亲为代孕宝宝的合法母亲而代孕宝宝为泰国公民。泰国没有代孕法律。外国人前往泰国代孕生子面临法律冲突。按照澳大利亚和美国的规定,澳、美公民在泰国所生育的代孕子女可获得澳洲或美国国籍,但要提供相关材料,特别是代孕合同、DNA检测报告证实父母子女血缘关系及泰国代孕母亲书面同意为代孕宝宝办理外国护照申请。以色列男同性恋者前往泰国代孕求子并已成功为代孕宝宝申请到以色列护照。泰国已制定代孕法律草案规范,但该草案未获得议会通过。

In Thailand,the woman who gave birth to a child is the legal mother of the child,and the children of Thai women are Thai citizens. Therefore,the Thai surrogate mother is the legal mother of the surrogate baby,and the surrogate baby born is a Thai citizen. There is no surrogacy law in Thailand. Foreigners seeking surrogacy in Thailand encounter legal conflicts. According to the laws in Australia and the United States,surrogate children of Australian citizens and of the citizens of the United States may be Australian and the United States citizens.Supportive documents for the citizenship applications include a surrogacy contract,a DNA report stating the biological connection between the commissioning parents and the surrogate child,and the surrogate mother＇s consent of applying for a foreign passport of the surrogate baby. Israeli gay couples having surrogate babies in Thailand have succeeded in applying for the babies＇ passports of Israel. Thai had made a surrogacy law draft,but it has not been approved by the Thai parliament.
