On the Independent Juvenile Justice

少年司法的分立从刑事古典学派、实证学派的思想中汲取理论准备,同时,关爱和回归的内在价值显现出少年司法独特的理论基石。基于立法推动和现实的障碍,目前的少年司法系统仍然存在着诸多的问题,但唯有分立的少年司法存在,基于此的独特理念、程序和非刑罚措施等诸多方面能够满足扶助非行少年重返社会的责任。

The theories of the classical school and the empirical school provide theoretical preparations for the development of juvenile justice model, so that the juvenile justice could produce and progress outside the criminal justice. Namely ,Juvenile justice finally earned the independence and became independent juvenile justice model which based on the unique stones：the intrinsic value of love and rehabilitation. Based on the realistic obstacles ,Juvenile justice system still exist many problems. If only the independent juvenile justice exists, the idea of procedures and many other aspects can rehabilitate juvenile delinquency.
