随着城市规模的发展和货运量增加的需求,部分城市中既有铁路货场能力已不能满足实际货运量的需要,地方政府往往会提出搬迁和异地新建铁路货场的要求。为保证搬迁和异地新建铁路货场的顺利实施,铁路方与地方政府需要通过协商签订搬迁框架协议和投资协议2份文件。如何按照平等、诚信的原则签订这2份文件,此文对签订这2份文件的注意事项提出建议。以减少履行协议过程中的争议和双方承担的风险。

With the increase of demand, the development of the urban scale and traffic volume in some cities in the railway freight yard capacity can not meet the need of the actual freight, local governments tend to ask for relocation and build new railway freight yard. In order to ensure the smooth implement of the relocation and building new railway freight yard, railroad authorities and Iocal government need to sign framework and investment agreements through consultation.
