摘要
上海自贸区法治建设本身就是制度创新,体现了与国际经贸新规则对接的要求。当前,在TPP、TTIP和TISA等谈判的推动下,国际经贸新规则体现出较强的开放特征。上海自贸区法治建设下一步内容包括:切实落实国际经贸基本原则;以法治原则完善"负面清单";以法治引领服务贸易领域的进一步开放;建立和完善行政法治体系;建立抽象性行政行为的审查机制;建立和完善有效监管的规则体系;完善对各类权益保护的实施细则;加强商事审判能力建设和建立风险防范体系等。
The construction of rule by law in Shanghai FTZ is itself an institutional innovation, meeting the need to integrate with the new international economic and trade rules. Currently, pushed by the negotiation of TPP, TTIP and IISA, the new international economic and trade rules are growing in- creasingly open. The construction of rule by law in Shanghai FTZ should include the following steps ： im- plementing the basic principles of international trade; improving the ＂negative list＂ in the principle of rule by law ; further opening the service trade under the framework of rule by law ; developing and impro- ving the legislative system of administration; building the review mechanism for abstract administrative acts; setting up and bettering the regulations on effective control; improving the implementation rules on various interest protection; building the judgment capacity of commercial practices and erecting the sys- tem of risk prevention.
