保险公估报告是作为保险公估机构对委托事项的结论性意见,其定位与效力不仅关系到保险诉讼纠纷的证据范围,更关系到保险公估机构的健康发展,本文在保险公估报告法律定位与效力的研究过程中,与司法鉴定意见相对比,通过分析二者的异同,以期借鉴相对成熟的司法鉴定相关经验,抛砖引玉,为我国新生的保险公估行业提供有益的启示。

The insurance assessment report as insurance assessment institutions on the matters entrusted to the concluding observations, its position and effect is not only related to the insurance litigation disputes evidence scope, but also to the healthy development of insurance assessment institutions, this paper studies the process of insurance assessment report on legal position and effect in contrast with the judicial authentication opinions, through the analysis, the similarities and differences of the two, to learn the relative judicial identifi cation of relevant experience, mature, provide benefi cial inspiration for China＇s nascent insurance assessment industry.
