反垄断法的自由价值探析

The Antitrust Law's Value of Freedom

反垄断法的价值追求十分多元化,自由价值作为反垄断法的基石价值,可以实现对公平与效率价值观的继承和超越。反垄断法中的自由价值突破了传统的放任性自由,逐渐转化成有限度的实质性自由。文章通过阐述现代反垄断法中自由竞争秩序与竞争者以及市场垄断之间的相互关系,分析我国目前反垄断法语境下自由价值的缺陷,并提出了相应的实现与完善思路。

The pursuit of the value of antitrust law is diverse. As the basic value of the antitrust laws,the value of freedom can inherit and surpass the value of fairness and efficiency.The value of freedom of antitrust Law has broke through the traditional freedom of indulgence and turned into the limited-substantively freedom. The relationship of the order of free competition,competitor and monopoly is elaborated. By analyzing the defects,suggestions are proposed.
