摘要
巴泽尔运用交易成本理论和博弈论对国家的起源、运作及法治的演进路径等问题进行了较为独特而深刻的分析,在国家理论方面作出了新的发现,发展了新制度经济学的国家理论。尽管巴泽尔的主要基于西方经验的国家理论没有科学地揭示国家的起源、本质、法治等问题,因而难有普适性与穿透力,但对转型中国实现国家治理法治化、现代化具有重要的启发意义。
Barzel applies transaction cost theory and gambling theory into the analysis of the origin and development of state and the evolution process of law.His perspectives are original and profound,which contribute fresh discovery to theory of state and improve theory of state of new institutional economics.Although Barzel does not explicate scientifically such issues as the origin and essence of state and the rule of law,so it is difficult for it to be applied widely and interpret deeply,transitional China can also learn much from it if it takes it seriously in modernization of state governance and rule of law.
