摘要
《道路交通安全法》实施以来,围绕着第76条规定的交强险的赔付原则以及交通事故损害赔偿的归责原则,理论和实务中进行了广泛地讨论。但是从目前的审判实务以及主流观点来看,现行中国的交强险的赔付原则无论从侵权行为法还是从保险法的角度来看都有其缺陷和问题。现行解释在给理论和实务带来混乱的同时,也增加了保险公司的赔偿负担。在借鉴其他国家现行强制责任保险的赔偿体系与模式的基础之上,有必要对中国现行的交强险赔付原则作出调整。从而实现"有效救济受害者"与"避免使加害人承担过重负担"两者之间的平衡。
Since the Traffic Safety Law' s enforcement, the payout principle of the mandatory third-party liability (MTPL) auto insurance and the liability principles of the traffic accidents have be.en discussed widely. However, from the current trial practices as well as the mainstream views in China, these principles are flawed either from the perspective of the tort law or the insurance law. The current explanations have not only brought about theoretical and practical chaos but also increased the burden of the insurance company. Through the comparison with other coun- tries' mandatory liability insurance and payout principles and models,it is necessary to make adjustments to China' s current payout principle of MPTL auto insurance in order to achieve the balance between "the relief of victims" and "overburden of the offender".
