追续权制度是我国《著作权法》第三次修订的一大亮点与热点。追续权在我国还是一个比较陌生的概念,并不为普罗大众所熟知,从追续权的性质、理论基础到该制度的具体运行规则都存在着进一步研究的可能与必要。文章旨在通过对本次《著作权法》修改草案中有关追续权的规定进行立法、理论、实务各角度的评析,从而试图厘清我国设立追续权制度的具体路径。

The system of Droit de Suite is a highlight and a hot spot in the third amendment of Copyright Law in China. In our country,Droit de Suite is an unfamiliar concept for the vast majority of Chinese people. It is,therefore essential and possible to research the characteristic,the theoretical basis and the specific operation rules of Droit de Suite. This article w ill comment and analyze the draft of the third amendment of Copyright Law from different aspects,such as legislation,theory and practice. The most important purpose of this article is to seek a w ay for establishing the system of Droit de Suite.
