法治文明:再论人民法庭建设

Legal Civilization: On Construction of People's Court

透过当代中国的法治发展,以文明之间的冲突为着眼点,通过分析法治社会的独特背景,明确人民法庭建设需面对的"三个问题":在对规则(法律)的认识上偏好区别对待而不注重标准;在对纠纷解决方式的认识上偏好实体公正而不认同程序公正;在对纠纷解决结果的认识上偏好实用主义而欠缺信仰。人民法庭建设要以现代法治理念为指导,创新司法审判模式,注重能动司法的可能选择。

Through the development of the rule of law in contemporary China and traced from the vantage point of culturalconflict,the paper presents three problems needed to be solved in the Construction of The People＇s Court through an analy-sis of the unique background of rural society：Making a difference on the understanding of laws instead of paying attention tostandard,preference of entity justice to procedure justice on the understanding of dispute solution,and preference of prag-matism to faith on the understanding of the dispute resolution results. The construction of people＇s court should be guided bymodern idea of rule of Law,innovation of judicial mode and attention to choice of judicial activism.
