我国保障性住房制度的法律思考——以甘肃省为例

On Legal Thinking of the Ensuring Housing System in China——Gansu Province as an Example

自我国住房制度改革实施以来,相当一部分公民的住房条件得到了巨大改善,面对节节攀升的高房价,我国制定了保障性住房制度,并在近些年得到了发展,为中低收入家庭改善居住条件作出了贡献。但该制度在发展过程中出现的许多障碍影响了其有效实施。文章从保障性住房制度构建中存在的障碍入手,对现行住房保障法律法规进行了梳理和评价,认为完善保障性住房制度应统一立法,尽快出台《住房保障法》;建立全面、动态的监管、准入、退出机制;加大监管惩罚力度;拓宽融资渠道,建立多元化分层次的保障房供应模式;并明确政府在保障性住房建设中的责任。

Since the implementation of the reform of the housing system,a considerable portion of the citizens has been a huge improvement in housing conditions.Faced with the rising price,China has formulated the ensuring housing system,and the system has been developed in recent years and it has contributed to improve the living conditions for low-income families.But many obstacles of the system appeared in the development process affected its effective implementation.The article will present and evaluate the current laws and regulations of the housing security from the existing obstacles in the process of building affordable housing system.The article presents some views on the improvement of the ensuring housing system,including unified legislation and introduction of＂housing security law＂as soon as possible;a comprehensive,dynamic regulation,entry and exit mechanism is established;supervision punishment should be increased;and broadened the financing channels,diversified and hierarchical modes of supply is established.And the responsibility of the government in the construction of affordable housing should be also cleared.
