甲午战争中,日本从法理上束缚中国手脚,利用国际法掩饰其侵略行径,抹黑清政府,博取国际舆论的支持,不断巩固其既得利益。而清政府消极应付,以致处处被动。中、日在国家转型战略、外交策略、国际法认知理念上的差距,决定了中日两国在甲午战争中国际法运用的巨大反差。分析这段历史,对于现代国际法运用有着重要的启示。

During the Sino-Japanese war of 1894-1895 , in order to get support from the international com-munity , and build on its vested interests , Japan made full use of the international law to cover up its aggression . By jurisprudential way , the Qing government had to respond so negatively that made itself in a passive position .The differences in national strategic transition , diplomatic maneuvers and the cognitive ideas of the international law be-tween two countries decided the contrast in application of the international law .And the analysis of this will enlight-en today ’ s application of modern international law .
