法律关系是法律规范在调整人们的行为的过程中所形成的一种特殊的社会关系,即法律上的权利与义务关系。监狱行刑法律关系,是指监狱在对罪犯依法执行刑罚的过程中与服刑罪犯构成的刑罚执行法律关系。它是监狱学所要研究的重大基础课题之一。在监狱行刑法律关系中,监狱拥有自己的权力和职责,罪犯享有一定的权利和义务,两者都有独立的意志,都是主体。监狱行刑法律关系具有主体的特定性、主体地位的矛盾对立性、主体意志的唯一性等特点。
