The Realistic Problems Faced by Patent System of China

针对中国专利制度存在的现实问题,建议逐步、适当提高专利授权的门槛,提高对专利申请中寻求保护的技术方案创造性的要求,实现从"数量"到"质量"升华;建议推动、促进专利成果的转移转化,早日突破专利运用的瓶颈;建议通过修改专利法加大对专利侵权的惩罚力度、增加专利侵权成本,从而有效提高专利保护水平。

In regards to the realistic problems of patent system of China, it is suggested a gradual and appropriate increase to threshold of patent authorization and creativity requirement of technical solutions in patent infringement cases in order to realize the sublimation from ＂quantity＂ to ＂quality＂. It is also suggested to promote and facilitate the transfer and conversion of patent achievements in order to breakthrough the bottleneck of patent application as quickly as possible. The penalty and cost for patent infringement should be enhanced through the revision of Patent Law for the purpose of the effective improvement of patent protection level.
