Study on Philosophy of Intellectual Property Law

英语文献中的知识产权法哲学主要针对知识产权法的正当性命题,而在汉语学术圈中关于知识产权法哲学的讨论还包括知识产权的对象等问题。知识产权法哲学的范畴可以从下述两个方面加以界定:其研究对象为知识产权法的基础理论,而在研究方法上则表现为哲学(或法哲学)的视角或进路。以一种更开阔的视野看待知识产权法哲学,其研究内容包括知识产权法的正当性、价值论、未来模式和形式理性以及知识产权的对象、知识产权案件的法律论证等课题。

The topic of philosophy of intellectual property（IP） law in English documents is mainly about the justification of IP law, while in Chinese academic circles it is still concerns about the objects of IP. The scope of philosophy of IP could be defined from two aspects： in term of research object it belongs to basic theory of IP law, while considering research method it is a perspective or approach of philosophy or philosophy of law. The research of philosophy of IP include topics such as justification of IP law, theory of value, future models and forms of rationality and the object of IP, legal argumentation of intellectual property cases if it is regarded from a broader perspective.
