对少数民族特色村寨保护与发展立法模式的思考

On the Thinking of Legislative Mode of Protection and Development of China's Ethnic Characteristic Villages

我国相关少数民族特色村寨保护与发展的现行立法存在诸多缺陷。从保护与发展的客体和立法技术论,少数民族特色村寨保护与发展立法应该兼采统一法典和单行法律、法规并用的立法模式,既需要制定少数民族特色村寨保护与发展一般法,又需要制定少数民族特色村寨保护与发展方面一系列特别法。制定少数民族特色村寨保护与发展一般法具有充分的可行性,制定少数民族特色村寨保护与发展特别法具有十分的必要性。

There is a defect in the current legislation on the protection and development of China＇s ethnic characteristic villages. On the object of protection and development and on the legislative technology,legislative mode of protection and development of ethnic characteristic villages should be adopted by unified code,separate laws,and regulations. It has been argued that the feasibility of formulating the general law and the need to enact a special law.
