On the Interrogative Method“To Subdue Activities with Inactivity”

以静制动侦讯法,是侦查员以较少的侦讯行为,将不明案情的劣势转化为已知案情的优势的方法。要将这一方法丰富完善,使之形成一种侦讯模式,需要研究其主客观条件制约的情势。在缺少案件材料、缺乏用证时机、需要隐蔽证据、掌握嫌疑人心理、创造讯问氛围等条件下,要实现以静制动,就需要选择合适的记录方式,需要在收集案件信息基础上精心谋划。在实施过程中,需要根据嫌疑人性格特点等采取动静交错的策略,以取得较好的侦讯效果。

The interrogative method, to subdue activities with inactivity, is such a method being used byinvestigators to change the disadvantage of an unknown case to the advantage of a known one by taking only afew interrogative activities. We need study the situation restricted by both subjective and objective conditions ifwe try to improve the method to be a pattern of interrogative method. On the conditions of lacking the materialof a case, being short of the opportunity for providing evidences, requiring hiding the evidences, holding thesuspect＇s mind, creating interrogative atmosphere, etc., if we want to subdue activities with inactivity, we shouldchoose a proper recording method and plan carefully based on collecting concerned information. In practice, thestrategy of using both active and inactive measures should be taken according to the characteristics of suspectsin order to obtain good interrogative result.
