摘要
海上货物运输留置权是一种维护承运人权益的重要法律方式。然而,对此现行法律缺乏明确规范,相关国际公约亦无明文规定。司法实务操作中,承运人对货物留置得当与否颇具分歧。从建设中国海事航运强国的目标出发,通过对《中华人民共和国海商法》相关条文的研判,结合海商海事审判实践,努力解读、诠释目前有限的海上货物留置权的法律依据,以期对现行海上货物运输留置权制度的科学完善,提出若干有建设性、参考性、实务性的意见和建议。
Lien on cargo is an important legal means to protect carriers' lawful rights and interests. However, existing laws in China lack a clear specification in this regard and so do the international conventions. The carrier' s right of lien also triggers a spirited controversy in judicial practice. The essay begins with the purpose of the construction of Chinese into a maritime power, attempting to explain and read accurately the limited legal provisions under Maritime Code of the People's Republic of China with judicial practice. Furthermore, the paper aims at providing several constructive suggestions on perfecting the sys- tem of lien on cargo by the carrier.
