摘要
承运人向托运人、收货人或提单持有人请求集装箱超期使用费的诉讼时效期间为1年已基本得到了司法界的认可。但纵观近几年出现的集装箱超期使用费纠纷案,由于没有相关法律法规明确规定"自承运人知道或应当知道权利被侵害之日起计算"具体应从哪个时间点开始计算,导致相关事议的发生。通过对相关案例的总结和分析,为今后处理集装箱超期使用费诉讼时效的起算点问题提供一些有价值的参考。
It is generally acknowledged that the limitation of action for the carrier to claim container detention charges against the shipper, consignee or bill of lading holder is one year. However, since no relevant laws or regulations clarifying the actu- al beginning date of the one year limitation of action, relevant arguments were caused accordingly. Therefore, by studying some relevant cases, the paper intends to provide some valuable reference for dealing with the argument on the beginning day to calculate the limitation of action for container detention charges.
