编造、故意传播虚假恐怖信息罪疑难问题实证研究

在这个充满风险的时代,将＂我想要炸某处＂一律排除在恐怖信息之外,是将复杂问题简单化、实质标准形式化,并不可取。爆炸罪的犯意表示虽然不可能构成爆炸罪,但可能构成编造、故意传播虚假恐怖信息罪。只要没有证据证明行为人表示出的犯罪意图是真实的,就属于虚假信息。但风险社会不应当成为草木皆兵的借口,导致模糊抽象的不安感、危惧感,并不等同于＂可能引起社会恐慌或者公共安全危机＂。编造,是以自己或他人传播为目的编造恐怖信息;传播,是将自己或他人编造的恐怖信息向特定或不特定人传播。无论是自编自传、还是既编又传,都构成编造、故意传播虚假恐怖信息罪。当行为人以投放虚假危险物质的方式,编造、故意传播与该虚假危险物质相关的虚假恐怖信息时,属于法条竞合,应认定为投放虚假危险物质罪。

If a person drops some false dangerous substances, and he also fabricate and disseminate some false terrorist information related to the false dangerous substances, this is called lapping of legal provisions, which should accuse the person of the crime of dropping false dangerous substances.
