农地产权“长久不变”的法律创新及其实现

产权期限是产权制度安排的重要内容。设计合理的产权期限,不仅影响资源的配置效率和财产的占有秩序,甚至与产权主体之间的权利义务关系稳定以及各项权能的有效运行紧密相关。自十七届三中全会之后,中央提出稳定农村土地承包关系并保持长久不变,多次重申和强调要明确"长久不变"的具体内涵。当务之急,应从市场经济法则和现代产权理论出发,按照十八届四中全会提出的用法治思维和法治方式治理国家的方针指向,把延长产权期限作为农地制度创新的着力点,加快顶层设计和立法突破,为农地产权关系稳定和顺畅高效运行提供坚实有力的法律保障。

Deadline of Property Right is one important content of Property Right System Arrangement. A reasonable property right deadline will not only influence the resource allocation efficiency and the order of proper possession,but also affect the stability of rights and obligations relationship among property owners and the operation efficiency of the functions. Since the Third Plenary Session of the Seventeenth Central Committee,stabilizing the land contract relationship and keeping it unchanged for a long time have been mentioned in the central policies and the meaning of 'unchanged for a long time 'is explained and emphasized for several times. Nowadays,the priority is to base on market economy principle,property right theory and the thought and ways of rule of law to make longer property right deadline the point of strength of farmland system innovation and to fasten the legalization design,which can provide law guarantee of the stable farmland property right relationship and its effective operation.
