摘要
罢工权在我国现行法律中没有直接的对应条款,这导致实务操作中的无法可依。然而,从法释义的角度上观察,罢工权有其存在的法权依据;从罢工权的人权属性视角观察,罢工权是法治发展的需求;从罢工权存在的功利视角观察,罢工权在劳资政三方利益博弈中不断发展。
There are no direct corresponding provisions in our country current law about the right to strike, which cause the lawless in the practice. However, looking at it from the interpretation of law perspective, the right to strike has its legal basis; E. g.: from the perspective of human rights, it is necessary for the development of the law; from the perspective of utility's value, it is developing at the game of labors, investors and government department's tripartite cooperation.
