法院调解保密原则研究

The Principle of Confidentiality in Court Mediation

作为我国民事司法制度的重要组成部分,司法调解以其灵活、便捷、低成本和社会效果好的特点,在我国民商事审判中发挥着重要作用。法院调解保密原则是调解问题的核心,它要求调解过程不公开,以促进当事人之间能够通畅交流,从而建立当事人对法院调解的信任,确保调解过程顺利进行。美国、瑞士、我国台湾地区均对法院调解保密原则做了详尽的规定。我国立法中虽规定了调解的信息保密原则,但调解保密性的立法与实践与法治发达国家仍有一定的差距。是故,为保障法院调解的顺利进行,塑造独立密封的法院调解程序空间,保持审判制度的良性运转,法院调解需更加注重调解程序与调解信息的保密性,相关立法亦需对法院调解保密原则保护的信息范围、应当遵守保密原则的对象、调审分离的程序设置加以明确规定。

Court mediation system is an important part of China＇s civil justice system. With its flexible, convenient, low cost and good social effect, mediation has been playing an important role in China＇s civil and commercial matters trial. In recent years, with the deepening of the reform of civil justice, the court mediation system has once again aroused great concern. The principle of confidentiality is a core problem in court mediation, it requires the tightness in mediation process, in order that the parties can communicate smoothly,and establish the trust of the court. United States, Switzerland, Taiwan had made detailed provisions on court mediation confidentiality. Although our legislation has been provided for the principle, the legislation and practice still have a certain gap compared with the developed countries. Therefore, in order to ensure the smooth progress of court mediation, shaping individually sealed court mediation space, maintaining the healthy functioning of the judicial system, court mediation needs to be more emphasis on confidentiality of mediation procedure and information, relevant legislation also needs to be more clearly on the scope of protected information, the object which should comply with the program settings in the separation of mediation and trial.
