卓越法律人才培养的伦理学视角

On Training of Outstanding Legal Talents from the Perspective of Ethics

卓越法律人才应该是具备卓越法律专业知识或专业技能,且具有基本的法律职业伦理的人才。在功利主义思想的影响下,以及法律职业伦理评价操作性不强的现实困境下,高校法学教育界过于偏重法科学生专业知识的"卓越性",而忽视了法科学生法律职业伦理素质的"基础性",如此可能导致法科学生"有才无德"的严重后果。为此,应在高校法学专业中开设法律职业伦理课程,加强法律职业伦理教育,提升法科学生传统的思想道德素质,帮助学生树立法律职业伦理意识。

The outstanding legal talents should have excellent professional knowledge or professional skills and basic ethics of legal professions.Under the influence of utilitarianism and the practical dilemma of the problems of the weak operability of the valuation of the legal professional ethics,the legal education in colleges and universities have paid more attention to the＂excellence＂of the professional knowledge for the law students,but neglected the＂fundamentality＂of their quality of ethics of legal professions.This kind of doing may lead to serious consequence for the law students ＂having abilities but no virtue＂.Therefore,it is necessary for us to offer the course of ethics of legal professions to strengthen the education of ethics of legal professions and to enhance traditional ideological and moral quality and to help the students to set up the ethic consciousness of the legal professions.
