预防性责任在环境侵权中的法律适用

与损害赔偿的事后补救功能相比,预防性责任是环境侵权中一种积极的事前救济措施。侵权责任中的预防性责任在保护环境以及受害人合法权益方面更为有效,但鉴于预防性责任在环境侵权中的"客观不能",我国立法、司法实践中应积极进行制度完善,促进预防性责任更好地适用。

Compared with the remedial function of damage compensation,preventive responsibility is a kind of positive environmental tort relief measures in advance.Preventive responsibility of tort liability is more effective in protecting the environment and the victim＇s legitimate rights and interests,but given preventive responsibility “objective can’t”in the environment infringement,we should actively improve the system,promote the preventive responsibility to be better applied in legislation and judicial practice.
