论《涉外民事关系法律适用法》的最密切联系精神

On the Most Connected Spirit of the Law of the Application Law for Foreign-related Civil Relations

《涉外民事关系法律适用法》不仅部分条款载有"最密切联系"字样,明示贯彻最密切联系精神,而且还有些条款以默示体现了最密切联系精神。但是其所表达的最密切联系精神仍是残缺的。对此,可以通过司法解释扩充最密切联系的适用范围,还可以通过个案形式,适度拓展最密切联系的空间,适当的时候也可以修改《涉外民事关系法律适用法》,提升最密切联系原则的地位。

The Law of the Application Law for foreign civil relations contains some articles which embody the words of “most significant relationship” to express the spirit of the most significant relationship clearly , but also some articles express the spirit implicitly .Even so, the spirit is still incompletely expressed .To meet the shortfall , we can issue judicial interpretations of the law to extend its sphere , and we can expand its space by individual cases , and at proper time ,we can also amend the law and upgrade the grand of the doctrine of the most significant relationship .
