依法治国背景下市场监管亟需明确的四个维度——从食品安全事件说起

Four Aspects of Market Supervision need to be determined urgently under the background of Ruling by Law——Starting from the food safety incidents

党的十八届四中全会以来,我国全面推行依法治国。目前我国安全生产、食品安全等方面出现的众多事件表明在依法治国背景下,国家法治化建设进程中市场监管改革与发展刻不容缓。市场监管作为政府基本职能的一个方面,公众顺理成章地认为政府是监管的唯一主体。目前存在着市场监管主体不明确、问责不合理等突出问题。本文在依法治国的背景下,鉴于回应性监管理论,从食品安全说起,分析了我国市场监管亟需明确的几个维度。

Since the Fourth Plenary Session of the 18th Central Committee of the Chinese Communist Party, the strategy of Ruling by Law has been comprehensively promoted throughout the country. The present growing incidents from the safety in manufacturing and foodstuff have sufficiently enunciated that under the ruling - by - law back- ground, the market supervision should be urgently reformed and developed in the progress of national legaliza- tion. Because market supervision is commonly regarded as one of the primary government functions, the public logically consider that the government is the only organization responsible for it. In addition, the problems of unreasonable monitoring subject and illogical accountability mechanism are also serious. Therefore, taking the strategy of Ruling Law as the background and starting from the food safety, this paper analyzed four urgent as- pects needed to be determined in Chinese market supervision based on the theory of responsive supervision.
