诱惑侦查是一种饱受道德争议的侦查措施。要使这种侦查措施获得人们的法律情感所接受,应当尽可能控制对被诱惑者的权益损害,这就要求在理论和司法实务中应当确立合适的诱惑侦查正当性标准,即以主观标准为主、客观标准为辅的混合标准,并且明确诱惑行为正当性的前提和"过度引诱"行为的界限,从正反两个方面将诱惑侦查行为限定在合法合理的限度内。同时,赋予被引诱者寻求救济的权利是非常必要的。

Entrapment investigation is one of investigative measures under moral disputes.To prevent the suspect entrapped from too much damage in rights and interests,the procedural justice standards of entrapment investigation should be established.The appropriate standard should be a mixed one that the subjective standard is the principle and the objective standard is the supplement.Moreover, the precondition of the entrapment and the limits of excessive entrapment should be defined.Thus the entrapment investigation can be controlled in the realm of legality and reasonableness from both affirmative and negative angle.At the same time,it is necessary to empower the suspect entrapped rights to seek remedy.
