我国夫妻共同财产制的立法价值取向经历了从家庭本位到个人与社会利益兼顾,再到现行立法过分偏重个人财产利益的演变。我们应从夫妻共同财产制立法价值取向的变迁中得出经验与教训,分析与批判古代立法价值取向,引进与消化近代立法价值取向,整合与提升未来立法价值取向。夫妻共同财产制的价值取向应把"公平正义"作为首要价值取向,同时兼顾平等价值和自由价值。

The legislation value orientation of conjugal property system has shifted from family orientation, to equal respect to the interests of the individual and society and overemphasis on the individual property. The study on the shift is of great significane for the heritance and criticism of ancient legislation value orientation, the introduction and absorption of modem value orientation, and the integration and promotion of future orientation, which comes to the conclusion that fairness and justice must be the primary value orientation of the conjugal property system, with due attention paid to the equality and freedom.
