An Legislative Analysis of the Construction Engineering Quality Management Based on Construction Law of PRC

依据法学和工程管理学的有关理论及建筑业实践,结合《建筑法》相关条款内容,主要基于"质量"和"标准"两个概念、建筑工程质量管理规律、立法技术适用等三个不同的视角,对《建筑法》关于建筑工程质量管理立法内容涉及的重要基本概念、工程管理规律遵循、立法结构和语言技术等,进行了多维度立体式的评析,揭示了《建筑法》在建筑工程质量管理立法方面,其立法质量科学性存在的不足表现和发生成因。为进行《建筑法》修订,特别是关于建筑工程质量管理方面的立法修订提供了新的思路和方法。

Based on the relevant theories of jurisprudence and engineering management and the practice of the construction industry, the paper studies the legal terms in Construction Law of People＇s Republic of China from three perspectives such as the conception of quality and standard, the rules of construction management and the application of legislative techniques. It also analyzes multi-dimensionally the basic conception of its content, the rules followed in engineering management and the legislative techniques of structure and language. As for the legislation of the Law, it points out that there are defects and factors in the scientificity of legislative quality, which provide new ideas and methods for the revision of Construction Law of PRC, especially for the legislation revision of construction engineering quality management.
